New York City Sues To Revoke Contractor License After Construction Workers Death

The Department of Buildings is seeking to have the special rigger license taken away from Wlodzimierz Tomczak, a contractor they say he failed to take "proper precuations" at a facade restoration project where an accident claimed the life of a construction worker.

Stone Falls, Killing 51-Year-Old Construction Worker

The fatal accident took place in Manhattan. The victim, a 51-year-old construction worker was on scaffolding halfway up a 14-story building when a coping stone was dislodged by rigging that was used to support the scaffolding. The stone struck the construction worker in the head, causing a traumatic brain injury.

He was rushed to a hospital where he later died.

The Department of Buildings investigated the accident which is standard protocol when a construction accident claims a life. When they asked Tomczak to produce records pertaining to the scaffolding setup and he failed to do so. The DOB claims that he did not follow standard protocol as is required by his special trigger license and instead allowed his untrained employees to do so. It was this failure that resulted in the death of the worker.

The DOB Is Cracking Down On Contractors

Although the DOB is working hard to try and keep construction sites safe for workers, the department only has so many employees for site inspections and they often don't catch issues before an accident occurs.

When construction workers are hurt or killed, the DOB may help to make changes and may revoke licenses or may even file criminal charges, but they can do nothing to help the victims recover compensation. This is where a construction accident lawyer comes in.

A lawsuit can help to recover full compensation for medical bills, wages that have been lost, physical suffering, emotional turmoil, and funeral and burial benefits.
