Jury Awards Family $12 Million After Doctors Fail To Detect Lung Cancer

Doctor Fails To Mention X-Ray Showed Lung Mass

In 2010, a woman in her mid-sixties went to the emergency room with extreme pain in her left ear. Doctors ordered a number of tests to determine what as causing her pain, including a chest x-ray. While nothing on the x-ray could explain her ear pain, one of the doctors identified a "non-specific density" in the left upper lobe of her lung, a density which doctors should have further investigated. Instead, they told her that her x-rays were normal.

In December of 2012, another doctor discovered the mass and biopsied it which determined that it was malignant. Less than a year later the patient died from stage 4 lung cancer.

Her family maintains that if the first doctor has informed the patient that a mass was present on her x-ray, she could have undergone aggressive treatments which could have potentially saved her life. They chose to file a medical malpractice lawsuit against the doctor and the hospital.

After hearing all arguments, the jury awarded the plaintiffs $10 million for the loss of the patient's life and an additional $2 million for the family's emotional pain.
